These Terms contain important legal provisions, including: Liability exclusions and limitations;
An indemnity in our favour;
Class-action and jury-trial waivers (to the extent permitted by law); and
A mandatory arbitration clause for most disputes.
They also contain critical safety and legal warnings about nitrous oxide. Misuse, including inhalation, can cause serious injury, permanent disability or death.
For clarity: We sell sealed, food-grade nitrous oxide cream chargers and related equipment for lawful culinary use only (e.g. whipping cream in approved dispensers).
We do not sell or supply nitrous oxide for inhalation, “getting high” or any other form of human consumption.
We use the words “nangs” and “Nangs Delivery” on this Site because they are common slang terms customers use to search for cream chargers online. Our use of those words is for branding and SEO only and must not be interpreted as promoting or supplying nitrous oxide for recreational or abusive use.
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded. Where any term would do so, it is to that extent read down or severed so that your non-excludable statutory rights remain unaffected.
If you do not agree to be bound by these Terms in full, do not use the Site or place an order.
1. Definitions
In these Terms, unless the context requires otherwise: “ACL” means the Australian Consumer Law in Schedule 2 to the Competition and Consumer Act 2010 (Cth), as applied in Victoria and other Australian jurisdictions.
“Agreement”, “Terms” means these Terms & Conditions of Use & Sale, as amended from time to time.
“Business Hours” means 8:00am to 9:00pm local time for Melbourne, Sydney and Brisbane, unless otherwise posted on the Site.
“Company”, “we”, “our”, “us” means the entity trading as “247NangsDelivery.com” and “247NangsDelivery”, including its directors, officers, employees, contractors, affiliates and permitted assigns.
“Culinary Use” means the lawful preparation, aeration or dispensing of food or beverages using approved equipment in accordance with manufacturer instructions and all applicable laws. Culinary Use expressly excludes inhalation, ingestion or any other form of human consumption of nitrous oxide.
“Customer”, “you”, “your” means the individual accessing the Site, placing an order or otherwise dealing with us.
“Driver” means an independent contractor engaged under a Delivery Services Agreement to collect Goods from our warehouse and deliver them to you. Drivers carry their own motor-vehicle, public-liability and goods-in-transit insurance and indemnify the Company for their acts and omissions.
“Force Majeure Event” means any event beyond our reasonable control, including severe weather, flood, fire, pandemic, strike, riot, government action, law-enforcement operation, road closure, major traffic accident or telecommunications failure.
“Goods” means nitrous oxide cream chargers/cylinders, whipped-cream dispensers and any related or ancillary items advertised on, or supplied via, the Site, in each case supplied solely for Culinary Use.
“Nangs”, “nang”, “nang delivery” and similar expressions are informal slang used in Australia to refer to small nitrous oxide cream chargers/cylinders. On the Site and in our marketing, these terms are used only as convenient shorthand for nitrous oxide cream chargers supplied for lawful Culinary Use. They do not mean, and must not be taken to mean, that the Goods are intended for inhalation, “getting high” or any other form of human consumption. Our use of slang terms such as “nangs” for branding, search-engine optimisation (SEO) or marketing reflects common language used by customers; it does not indicate that we encourage, condone or supply nitrous oxide for recreational or abusive use.
“Non-Excludable Rights” means any rights, remedies, guarantees or warranties you have under the ACL or any other law that cannot lawfully be excluded, restricted or modified (including consumer guarantees that goods will be of acceptable quality and reasonably fit for disclosed purposes).
“Service States” means Victoria (VIC), New South Wales (NSW) and Queensland (QLD), Australia. We only deliver Goods to addresses in the Service States unless we expressly agree otherwise in writing.
“Site” means the 247NangsDelivery.com website, its subdomains, mobile applications and any communication channel we use, including SMS, telephone, WhatsApp and social-media accounts.
2. Acceptance of Terms
By accessing, browsing, communicating through or placing an order via the Site, you confirm that you: have read and understood these Terms; and agree to be legally bound by them in full.
2.1 No agreement, no use If you do not accept each provision of these Terms, you must immediately stop using the Site and must not place an order.
3. Eligibility, Age & Lawful Purpose
3.1 Minimum age & capacity By using the Site or ordering Goods you warrant that: you are at least 18 years of age or the legal age of majority in your jurisdiction, whichever is higher; and you have full legal capacity to enter into this Agreement.
3.2 Lawful purpose only The Goods are supplied solely for Culinary Use and for no other purpose. You acknowledge that in Australia, and in each of the Service States, it is an offence to supply nitrous oxide for human consumption and that nitrous oxide may be regulated as a poison or restricted substance under various laws. By placing an order you warrant that you are not acquiring the Goods: for inhalation or any other form of human consumption; for supply to any person you know or reasonably suspect intends to inhale or otherwise consume nitrous oxide; or in circumstances that would breach any law in your state or territory.
3.3 Identity & age verification We may require you (or any person accepting delivery) to provide government-issued photo identification (e.g. driver licence, passport, Keypass) and/or proof of age and address before completing any sale or delivery. We may refuse to hand over Goods or may cancel an order where: satisfactory identification is not produced; details on the identification do not reasonably match the order; or we reasonably suspect that the Goods will be misused or supplied to a minor. To the extent permitted by law, you are not entitled to any refund where we refuse delivery for the reasons above, except as required under your Non-Excludable Rights.
3.4 Right to refuse service We may, at any time and in our sole discretion (acting reasonably and subject to the ACL), refuse, cancel, suspend or restrict service or delivery to any person or address, including by: declining new orders; limiting quantities; imposing order caps or cooling-off periods; or closing or flagging customer profiles where we reasonably suspect misuse, unsafe behaviour, fraud or breach of these Terms.
3.5 Service States only (VIC / NSW / QLD) We currently accept orders and deliver Goods only within the Service States. If you submit an order for delivery outside the Service States without our prior written consent, we may cancel the order and refund any amounts paid (less any non-refundable merchant or processing fees), subject to your Non-Excludable Rights.
4. Product Use, Safety & Misuse
4.1 Intended use only The Goods are intended only for Culinary Use in accordance with: manufacturer instructions; and all applicable laws and regulations in your jurisdiction. Misuse of nitrous oxide—including inhalation, use with balloons or masks, or any other form of human consumption—can cause serious injury, permanent disability or death. References on the Site to “nangs”, “Nangs Delivery”, “nang delivery” or similar expressions are to nitrous-oxide cream chargers for lawful Culinary Use only and must not be interpreted as promoting or supplying nitrous oxide for inhalation or any other form of human consumption.
4.2 Customer warranties By ordering, you expressly warrant that you will: not inhale nitrous oxide, nor encourage, assist or permit any other person to inhale or otherwise consume it; not sell, supply or make Goods available to any person under 18; store cylinders: upright, below 50°C, out of reach of children and unauthorised persons, and away from heat, sparks, naked flames and direct sunlight; use only approved, compatible dispensers and follow all manufacturer and safety instructions; and comply at all times with all laws that apply to the purchase, storage, transport, use and resale of nitrous oxide in your state (including any limits on display, age of purchaser, hours of sale, quantity per sale, and record-keeping).
4.3 Release & assumption of risk (subject to Non-Excludable Rights) You acknowledge the inherent risks associated with handling compressed-gas cylinders. To the maximum extent permitted by law, and without limiting your Non-Excludable Rights, you release and hold us harmless from any claim, loss, injury or death arising out of: misuse of the Goods (including inhalation or other human consumption); failure to follow safety instructions; unsafe storage, handling or transport of the Goods after delivery; or your breach of these Terms or applicable law.
4.4 No medical or legal advice Content on the Site is general information only and is not medical, toxicology or legal advice. You must seek advice from: a qualified medical professional in relation to any health concern; and a lawyer if you are unsure about your legal obligations concerning nitrous oxide.
5. Orders & Processing
5.1 Instant processing Orders placed via the Site are usually processed and allocated to an available Driver immediately. Unless we expressly agree in writing to delay dispatch, your order may proceed immediately and cannot be modified once a Driver is assigned.
5.2 Offer & acceptance Your order is an offer to purchase Goods on these Terms. Our acceptance occurs when we: send an order-confirmation email/SMS; or dispatch the Goods; whichever happens first.
5.3 Cancellation by you You may request to cancel or modify an order only before a Driver is assigned. Once a Driver’s status displays “On the way”, “Out for delivery” or similar: the order becomes non-cancellable; and we may charge or retain a A$25 (GST-incl.) delivery fee even if you later refuse delivery, are not available at the address or request an address change. This clause does not limit any right you may have to cancel or obtain a refund or replacement under your Non-Excludable Rights (for example, where Goods are not supplied within a reasonable time or are not of acceptable quality).
5.4 Cancellation by us We may cancel an order before delivery, in whole or in part, where: we reasonably suspect fraud, misuse, unlawful purpose or supply to a minor; we are unable to verify your identity or age; there is a Force Majeure Event; there is a material pricing, description or stock error; or the order would breach any law or regulatory requirement (including state-based nitrous oxide rules). Your sole contractual remedy for such cancellation is a refund of amounts actually paid for undelivered Goods, without limiting any additional remedies you may have under the ACL.
5.5 Payment processing fees Where: you validly cancel an order before dispatch; or we cancel an order for reasons not caused by your breach, we may deduct or withhold non-refundable merchant or payment-processing fees charged by your payment provider, to the extent permitted at law.
6. Pricing, Taxes & Payment
6.1 Prices & GST All prices are in Australian Dollars (AUD) and, unless stated otherwise, include GST.
6.2 Payment authorisation By submitting an order, you authorise us (and our payment processors) to charge your nominated payment method for: the purchase price of the Goods; applicable delivery, rerouting and restocking fees; and any surcharges disclosed at checkout.
6.3 Pricing errors We may correct obvious pricing or description errors. If the correct price is higher than the displayed price: we will contact you and give you the choice to cancel or proceed at the correct price; and if you cancel, we will refund amounts paid for the affected Goods, without limiting your Non-Excludable Rights.
7. Delivery Service
7.1 Coverage (VIC / NSW / QLD) We provide same-day and rapid delivery within the greater Melbourne (VIC), Sydney (NSW) and Brisbane (QLD) metro areas shown on our coverage map. Regional or remote areas in these states may be serviced by standard courier with longer timeframes. We do not accept orders for delivery outside the Service States unless we expressly agree otherwise in writing.
7.2 ETA & time not of the essence Our average metro ETA is approximately 30 minutes, but this is an estimate only, not a guarantee. During peak traffic, severe weather, major events or for distant suburbs, delivery may take 2 hours or more. Time is not of the essence in respect of delivery, except where required by your Non-Excludable Rights. Local laws in particular states (for example any restrictions on night-time sales or rapid delivery of nitrous oxide) may override our usual delivery windows. We may modify, restrict or refuse orders to comply with such laws.
7.3 Independent Drivers & risk in transit Deliveries are fulfilled by independent contractor Drivers who carry their own insurance and indemnify the Company for their acts and omissions. To the maximum extent permitted by law, and subject to your Non-Excludable Rights, you acknowledge that: Drivers are not our employees; and risk of loss or damage in transit passes to you once the Goods are handed to a Driver for delivery to your nominated address. Nothing in this clause limits our obligations under the ACL where Goods fail to meet a consumer guarantee (for example, where they are lost or damaged and you are entitled to a remedy).
7.4 Authority to Leave (ATL) All orders are treated as Authority to Leave by default. If no one is present, the Driver may leave the Goods in a location they reasonably consider secure and discreet at or near your delivery address. If you require a signature on delivery or have special-handling requirements, you must request this before checkout. Additional fees may apply. Once Goods are delivered or left ATL, you are responsible for any loss, theft or subsequent misuse, subject to your Non-Excludable Rights.
7.5 Incorrect or changed address Providing an incorrect address or requesting an address change after dispatch may incur: a A$25 rerouting fee; plus any additional distance or toll surcharges. Delivery clocks pause while we await payment of such fees and updated instructions.
7.6 Delivery failure If delivery fails because: you supplied incorrect or incomplete details; you refused delivery; or you or your authorised recipient were unreachable or unavailable, we may return the Goods to stock. In that event, we may refund amounts paid less: delivery fees; applicable merchant or processing fees; and a reasonable restocking fee, subject always to your Non-Excludable Rights.
7.7 Damage in transit Claims for transit damage must be lodged within 30 minutes of the delivery time recorded by the Driver or courier and must include clear photographic evidence. Our contractual liability is limited to, at our election: replacement of affected Goods; or refund of the price you paid for those Goods, without limiting your Non-Excludable Rights.
8. Defects, Returns & Abuse Policy
8.1 Notification window Claims for defective or non-delivered Goods must be submitted in writing (email, SMS or WhatsApp) within 24 hours of the delivery time recorded by our Driver/courier. Claims lodged after 24 hours are invalid and will not be honoured, except where Non-Excludable Rights under the ACL apply.
8.2 Consumable nature Gas cylinders are consumables. We do not accept returns for change of mind once delivery is accepted, subject to your Non-Excludable Rights.
8.3 Defect rate & evidence Our historical manufacturing defect rate is low. If you believe a cylinder is faulty, you must provide clear, unedited video evidence showing: (a) cylinder weight on calibrated scales; (b) the intact manufacturer seal, brand and batch number; and (c) an attempt to dispense using an approved, compatible device. We may require additional information or inspection to verify the alleged defect.
8.4 One-for-one replacement Verified manufacturing defects will be replaced like-for-like at no extra cost once per order. Multiple or serial claims across different orders may be flagged for investigation. We may refuse replacements where evidence is objectively insufficient or inconsistent or where we reasonably suspect abuse, tampering, fraud or misuse. This replacement policy is in addition to, and not a replacement for, your Non-Excludable Rights.
8.5 Abuse prevention Submitting false, exaggerated or dishonest defect claims is a breach of these Terms. We may respond by: suspending or terminating your access to the Site; refusing future orders; seeking recovery of costs and losses; and/or reporting suspected fraud or unlawful conduct to payment processors, consumer regulators or law-enforcement agencies.
8.6 Statutory rights – ACL notice Nothing in this Section limits your rights under the ACL. Where Goods fail to meet a consumer guarantee and the failure is major, you are entitled to a refund or replacement and, in some cases, compensation for reasonably foreseeable loss. For minor failures, you are entitled to a repair, replacement or refund at our election.
9. Compliance With Law & Prohibited Conduct
9.1 Your responsibility for legal compliance You are solely responsible for ensuring that the purchase, possession, storage, resale and use of nitrous oxide is lawful in your jurisdiction, including: any age restrictions; limits on hours of sale or rapid delivery; quantity limits per transaction; and display, labelling and storage requirements.
9.2 Prohibited conduct You must not: sell, supply or otherwise make Goods available to any person under 18; inhale, ingest or otherwise consume nitrous oxide, or encourage, assist or allow any other person to do so; represent, advertise or imply that the Goods are safe or appropriate for recreational inhalation; resell, export or distribute the Goods in any way that breaches applicable laws or regulations; tamper with, obscure or remove packaging, labels, batch numbers or safety seals; or misuse the Goods in any way likely to cause harm, property damage or criminal liability.
9.3 Co-operation with authorities We may, where required or permitted by law, co-operate with consumer regulators, health authorities and law-enforcement agencies, including by: providing transaction records, delivery addresses and communications; and complying with any lawful request or order concerning suspect purchases or misuse of nitrous oxide.
9.4 State-specific obligations (VIC, NSW & QLD) (a) Victoria (VIC): In Victoria, nitrous oxide products may be treated as poisons or regulated substances. It may be an offence to sell or supply a regulated substance where the seller knows or has reasonable cause to believe it will be inhaled or otherwise improperly consumed. You must not ask us to supply Goods if you intend to inhale them or supply them to anyone else for human consumption. (b) New South Wales (NSW): In NSW, it is an offence to sell or supply nitrous oxide knowing it is for human consumption. By ordering Goods for delivery in NSW, you confirm you are purchasing solely for lawful Culinary Use. (c) Queensland (QLD): In QLD, nitrous oxide is regulated and misuse can trigger enforcement action. You confirm you are purchasing for Culinary Use and are not engaged in the sale of illicit tobacco or vapes.
10. Warranty Disclaimer
Except for your Non-Excludable Rights under the ACL, the Site and Goods are provided “as is” and we make no additional express or implied warranties.
11. Limitation of Liability
11.1 Excluded loss To the maximum extent permitted by law, we are not liable for any indirect, incidental, punitive or consequential loss.
11.2 Aggregate cap Subject to your Non-Excludable Rights, our aggregate liability is limited to the lesser of: the total amount you paid for the relevant order; or AUD $500.
12. Indemnity
To the fullest extent permitted by law, you indemnify and hold harmless the Company from any claim or loss arising from your breach of these Terms, your misuse of the Goods, or any third-party claim related to your resale or supply of the Goods.
13. Third-Party Services
We are not responsible for the content or policies of third-party websites or payment processors linked on the Site. You access them at your own risk.
14. Force Majeure
We are not liable for delay or failure to perform caused by a Force Majeure Event.
15. Dispute Resolution
15.1 Good-faith negotiation You must first contact us at [email protected] and allow 10 Business Days for a response.
15.2 Class-action waiver Disputes will be pursued only on an individual basis.
15.3 Arbitration If not resolved, the dispute must be submitted to confidential arbitration in Melbourne, Victoria.
16. Governing Law
This Agreement is governed by the laws of Victoria, Australia.
17. Changes to Terms
We may amend these Terms at any time by posting an updated version on the Site.
18. Severability
If any provision is held invalid, the remaining provisions remain in full force.
